According to Florida Statue 316.193, a DUI that causes property damage occurs when an individual drives a vehicle or is in physical control of the vehicle while under the influence of drugs and/or alcohol, has a breath alcohol or blood alcohol level of .08% or higher while operating a vehicle, and causes damage, either directly or indirectly, to the property that is owned by another individual.

The Consequences of a DUI with Property Damage

Being charged with a DUI that results in property damage is a serious offense and is classified as a first Degree misdemeanor in the state of Florida. As such, any individual that is found guilty of committing this crime is subject to serious consequences, which can include any one or a combination of any of the following penalties:

  • A jail term of up to 12 months
  • A reporting probationary period of up to 12 months
  • A minimum revocation of 6 months of a driver’s license, with a maximum of a 12 month revocation
  • A fine between $500 and $1000
  • Impounding or immobilization of the vehicle that was being used for a 10 day period
  • 50 hours of community service
  • The completion of a psychosocial evaluation, which will determine if substance abuse treatment is necessary
  • The completion of any substance abuse treatment that has been recommended

Depending on the case, stronger penalties may be issued. For example, if a person has a blood alcohol of .15 or higher, the minimum fine will be $1,000, but will not exceed $2,000 and a placement of an ignition interlock device on all vehicles that are used, owned or regularly operated by the convicted individual for a period of 6 months, but not more than 1 year. If a minor was in the vehicle when the accident occurred, the minimum fine will be $1,000, but will not exceed $2,000.
